TERMS AND CONDITIONS
- By ordering any of our products, you agree to be bound by these terms & conditions.
- By placing an order at Roots Kitchen, you warrant that you are at least 18 years old or have parents’ permission to buy from us.
- The price applicable is that set at the date on which you place your order.
- We reserve the right to refuse service to anyone for any reason at any time.
- Roots Kitchen reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice.
- You agree to provide current, complete and accurate purchase information for all purchases made at our store, including but not limited to contact information, delivery address and delivery instructions.
- We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
All personal information you provide us with or that we obtain will be handled by Roots Kitchen. The personal information you provide will be used to ensure deliveries to you and to personalize your service. The information you provide is only available to Roots Kitchen and will not be shared with other third parties. You have the right to inspect the information held about you. You always have the right to request Roots Kitchen to delete or correct the information held about you. By accepting the Roots Kitchen’s conditions, you agree to the above.
WEATHER & TRAFFIC ALLOWANCES
Our delivery drivers do their best to get your food to you on time so you may enjoy it at its freshest. Still, they may run into delays due to weather, traffic and other factors that are outside of their control. We cannot guarantee delivery within your selected time slot. In instances of inclement weather, we hold the right to cancel our deliveries in order to avoid putting our delivery teams at risk. In such a case, we will notify you as early as possible and when possible, arrange delivery the following day, or at the earliest convenience. If this does not suit your schedule, please let us know and we will do our best to find a better arrangement. As both traffic and weather are outside of Roots Kitchen’s normal control, cash refunds cannot be issued for affected orders.
PRODUCTS, AVAILABILITY AND CANCELLATION
All products are subject to availability. We do our best to keep in stock most products however at the event when a product is sold out, Roots of Health has the right to cancel the order and issue a refund or credit at Roots Kitchen’s discretion. Roots Kitchen shall also notify the customer of equivalent replacement products if available. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
FOOD SAFETY, STORAGE AND DAMAGE
Once your order has been delivered, you are responsible for refrigerating and correctly storing the meals and related products. We will not be responsible nor liable for any harm, loss or damage suffered by you or any other individual, that is caused, directly or indirectly, by your incorrect use, storage or handling of our food and the related products. While we take care in the preparation and packaging of your meals and related products, before you consume the food or any related products, please consider that they are produced in facilities which handle a range of food products, including, but not limited to, milk, eggs, soya, seafood, peanuts, seeds, and gluten. It is not possible to guarantee the total absence of these ingredients in any of our food and related products. Please always check the ingredients before consumption. All Roots Kitchen’s meals are to be kept refrigerated until consumed and freshness cannot be not guaranteed past the 4th day upon receipt. It is up to the customer to maintain freshness once received. Our meals are packaged with insulated coolers and ice packs and will typically remain cold and fresh for several hours, but depending on the season and temperature in your geographic area at the time of delivery, advance planning by you should be made for immediate and proper storage of your meals prior to consumption. It’s important to put your Roots Kitchen meals and perishable items in the refrigerator when you receive them. By purchasing food from Roots Kitchen, you agree to properly and promptly refrigerate all meals until you plan to eat them. Since all of our food is fresh (and preservative-free, chemical-free, etc.), it may spoil if not properly taken care of. Once the delivery has been made based on your specifications, we are no longer responsible for any damage or delay on part of other persons, circumstances, or for the security of its contents. You are responsible for inspecting all products you receive from us for any damage or other issues upon delivery. In addition, you are solely responsible for determining the freshness of the products you receive. If you think the contents are not suitable for consumption or have been tampered with, please let us know as soon as possible so we can find a more suitable arrangement for the next delivery. Roots Kitchen is not responsible for damage or loss of personal property during deliveries if evidence of misconduct cannot be provided.
You agree to pay the purchase price specified on the Site at the time that you place your order, plus any applicable delivery and insurance charges. All amounts are stated in Canadian dollars. All purchase prices include Canadian HST (where applicable). Delivery and any insurance charges will be separately shown.
Roots Kitchen is not responsible for failed deliveries due to incorrect or incomplete addresses. If you have requested for us to deliver to a specific address, it is your responsibility to arrange for someone to be available to receive the delivery. If there is no one available to collect the order, and you have not recommended to us a cool, safe place for delivery of your order, we will leave the order at your door or the safest available spot. If you have advised us of specific delivery instructions in relation to your order, we will endeavor to comply with these instructions to the extent reasonably within our control. If we are unable to reasonably comply with these instructions, we will leave the order at your door. You acknowledge and agree that you are responsible for your order from the time that your order is delivered, and we accept no liability or responsibility once your order has been delivered to your stated address.
You must provide us with a safe place to deliver your cooler. We are not responsible for the cost of food if your cooler is stolen. Any individual at the delivery address who accepts a delivery from us is presumed to be authorized to receive such delivery. In cases in which you have designated an alternative receiver, such person shall accept the delivery under all of the same terms and conditions that would apply had you accepted the delivery yourself.
ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information about our goods and services is inaccurate
at any time without prior notice (including after you have submitted your order).
RETURNS, REPLACEMENTS, REFUNDS, AND CREDITS
Since our products are handcrafted and made-to-order with fresh ingredients, we cannot accept returns. All sales are final. If a product arrives damaged or you have concerns, please contact us immediately (firstname.lastname@example.org).
Refunds will not be issued for delays that are the result of factors outside Roots Kitchen control, including but not limited to weather, traffic, and unexpected events as they relate to our delivery drivers. If for any reason have we have to cancel your delivery, you will be notified by email, and the number of meals canceled will be credited to your account which will be applied towards your next order. If this does not suit your schedule, please let us know and we will do our best to find a better arrangement.
Depending on the circumstances, we may, in our sole discretion, replace the meal or products, provide you with a full or partial refund for the purchase price of that meal or products, or provide you with a credit for that meal or product that will be automatically applied to future deliveries for your next order. If issued, a refund may take 3-5 business days to show up, depending on which bank you use. If you are provided with a credit for a future order, we may implement the credit in a variety of ways at our discretion, including providing you with a discount code to use on a future order, or applying a credit to your account, which will be automatically deducted from your next payment.
